These Terms of Service (“Terms”) govern your access to and use of Lumière. By creating an account or using the service, you agree to these Terms.
1. The service
Lumière is a platform that lets professional photographers upload photographs and deliver them to their clients through private, brandable online galleries, with optional PIN protection, downloads, and client favourites.
2. Accounts and eligibility
You must be at least 18 years old and able to enter into a binding contract to use Lumière. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Email verification is required before you can access the portal.
3. Plans and billing
Lumière offers three plans: Free, Pro ($10 / month), and Studio ($20 / month). An annual billing option is available at a reduced effective rate. There is no free trial of the paid plans — billing begins when you upgrade, and paid plans renew automatically until cancelled.
You can change or cancel your plan at any time from the portal. Cancellation takes effect at the end of the current billing period; we do not provide pro-rated refunds for partial periods except where required by law.
4. Your content and ownership
You retain full ownership of all photographs and other content you upload. We claim no ownership of your work.
You grant Lumière only the limited, non-exclusive licence necessary to host, store, process, and display your content for the purpose of operating the service and delivering your galleries to the recipients you designate. This licence ends when the content is deleted, subject to routine backup cycles.
5. Acceptable use
You agree not to use Lumière to store or share content that is unlawful, or that infringes the rights of others. In particular:
- you are responsible for having all necessary rights to the photographs you upload, including any required consent from the people depicted in them and from your clients;
- you must not upload unlawful, infringing, or harmful content; and
- you must not attempt to disrupt, reverse-engineer, or gain unauthorised access to the service.
6. PIN protection
PIN protection is an access-control convenience that requires visitors to enter a code before viewing a gallery. It is not a guarantee of confidentiality or security. You should not rely on PIN protection alone to safeguard highly sensitive material, and you remain responsible for how you distribute gallery links and PINs.
7. Deactivation and termination
You may deactivate your account at any time. On deactivation, a 30-day grace period applies during which your portal and galleries remain fully accessible. After the grace period, the portal is locked and galleries go dark; your data is retained unless you request deletion. We may suspend or terminate accounts that violate these Terms.
8. Limitation of liability
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Lumière is not liable for any indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill arising from your use of the service. Nothing in these Terms excludes liability that cannot lawfully be excluded.
9. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of Lumière after changes take effect constitutes acceptance of the revised Terms.
